By accessing and using Pixsjoy ("the App," "Service," "we," "us," or "our"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Anna Jia, the developer of Pixsjoy.

2. Description of Service

Pixsjoy is an AI-powered photo generation application that allows users to:

• Upload personal photos
• Generate customized AI-created images using uploaded photos
• Save and manage generated images
• Purchase tokens to access generation services

The Service uses artificial intelligence technology to create unique images based on your uploaded photos and selected themes/styles.

3. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use Pixsjoy. By using the Service, you represent and warrant that:

• You meet the minimum age requirement
• You have the legal capacity to enter into these Terms
• You will comply with all applicable laws and regulations
• All information you provide is accurate and current

4. User Responsibilities

4.1 Acceptable Use

You agree to use Pixsjoy only for lawful purposes. You will NOT:

• Upload photos of individuals without their consent
• Upload photos of minors (under 18) without parental/guardian consent
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Upload content that infringes on intellectual property rights
• Upload sexually explicit, violent, or graphic content
• Use the Service to harass, stalk, or harm others
• Attempt to reverse engineer or hack the Service
• Use the Service to create deepfakes or misleading content
• Violate any applicable laws or regulations

4.2 Content Guidelines

Uploaded photos must:

• Be photographs of real people (not artwork or illustrations)
• Show clear, recognizable faces
• Be appropriate for general audiences
• Not violate any third-party rights

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to the photos you upload. By uploading photos, you grant us a limited, non-exclusive license to:

• Process your photos through our AI system
• Generate customized images based on your photos
• Temporarily store and transmit your photos for processing purposes

This license terminates when processing is complete and your photos are deleted from our servers.

5.2 Generated Content

Ownership: AI-generated images created through Pixsjoy are owned by you. You may:

• Use generated images for personal purposes
• Share generated images on social media
• Print generated images for personal use

Restrictions: You may NOT:

• Sell generated images for commercial purposes without proper licensing
• Use generated images to impersonate others
• Use generated images in a misleading or harmful manner
• Claim that generated images are original photographs

5.3 Our Intellectual Property

Pixsjoy, its logo, design, features, and underlying technology are owned by [YOUR_COMPANY_NAME] and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Use our trademarks without permission
• Reverse engineer the App or our AI models

6. Token System and Purchases

6.1 Token Usage

• Tokens are virtual credits used to generate AI images
• Each image generation costs 1 token
• Free tokens may be provided to new users
• Tokens do not expire
• Tokens are non-transferable between devices or users

6.2 Purchases

• All purchases are processed through Apple's In-App Purchase system
• Prices are displayed in your local currency
• All sales are final unless otherwise stated
• Apple's payment terms apply to all transactions

6.3 Refund Policy

Token purchases are generally non-refundable. However, you may request a refund in the following circumstances:

• Technical issues prevented service delivery
• Unauthorized purchases (subject to verification)
• Service outage that prevented token usage

6.4 Promotional Offers

We may offer promotional pricing or bonus tokens. Promotional terms:

We strive to provide continuous service, but we do not guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Specific generation quality or results
• That the Service will meet your specific requirements

7.2 Maintenance and Updates

We may:

• Perform scheduled maintenance (we'll try to notify you in advance)
• Update the App to add features or fix bugs
• Modify or discontinue features at our discretion

7.3 Service Termination

We reserve the right to:

• Suspend or terminate your access for violations of these Terms
• Discontinue the Service with reasonable notice
• Delete inactive accounts after extended periods of non-use

8. AI-Generated Content Disclaimer

Important Notice: Images generated by Pixsjoy are created using artificial intelligence and may:

• Contain imperfections or artifacts
• Not perfectly match your expectations
• Vary in quality and accuracy
• Reflect biases present in AI training data

We make no guarantees about:

• The quality or accuracy of generated images
• The suitability of generated images for any particular purpose
• The resemblance of generated images to uploaded photos

Responsible Use: Users should clearly label AI-generated images when sharing them publicly to avoid misleading others.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE PAST 12 MONTHS
• WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES OR CONTENT

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Anna Jia from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload or generate

11. Privacy

12. Dispute Resolution

These Terms shall be governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.

12.2 Arbitration

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

• After the "Last Updated" date is changed
• When you continue to use the Service after changes are posted

Material changes will be communicated through in-app notifications. Your continued use constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Anna Jia regarding the use of Pixsjoy and supersede all prior agreements.
